Terms & Conditions for clients using AMHS website and therapy services — scope, eligibility, consent & confidentiality (MHCA 2017), Pay-at-Clinic, refunds, fees, platform use, and jurisdiction.

Welcome to Avalamban™ Mental Healthcare Services (AMHS). These Terms & Conditions govern your access to and use of our website and therapy services as a client. By booking a session, registering on our platform, or otherwise using our services, you agree to these Terms. If you do not agree, you may not use our services. A separate set of Terms & Conditions applies to therapists engaged by AMHS.

1. Scope of Services

AMHS provides professional psychotherapy and mental health support in online and offline (in-clinic) mode. Online sessions are delivered exclusively through the video link generated by the AMHS dashboard at the time of booking. Our services are designed to promote psychological well-being but are not a substitute for emergency or crisis care. If you are in immediate danger, please contact local emergency services or a crisis helpline.

Therapy outcomes vary for each individual. AMHS does not guarantee specific results from therapy sessions.

2. Client Eligibility

  • Services are available to individuals 8 years and older.
  • Minors may access services only with verified parental or guardian consent.
  • By registering, you confirm that the information you provide is accurate, complete, and up to date.

3. Consent & Confidentiality

Consent is obtained automatically as part of your registration on the AMHS dashboard, before you can book your first session. By registering, you acknowledge: (a) the scope, risks, and benefits of therapy; and (b) the limits of confidentiality, including legal obligations to report imminent harm, court orders, or child protection concerns.

Confidentiality is strictly maintained, and your personal/therapy records are not shared without your consent, except as required by law.

Compliance with Mental Healthcare Act, 2017

  • You have the right to access quality, affordable mental healthcare.
  • Your right to privacy and confidentiality will be respected, subject to legal exceptions.
  • You have the right to informed consent before any treatment.
  • You have the right to refuse or discontinue therapy at any time.
  • Services are provided without discrimination on the basis of gender, caste, religion, sexual orientation, or financial status.

4. Appointments & Payments

There is no uniform fee applicable across the AMHS platform. Each mental health professional specifies their own charges, which are transparently displayed on their profile page and/or at the time of booking. AMHS is not responsible for standardizing or equalizing the fee structure across professionals.

Online sessions:

  • Sessions are booked on a prepaid basis.
  • A session slot is confirmed only once payment has been completed. Unpaid bookings may be released without notice.
  • Payments are processed securely through Razorpay or other approved methods (UPI, PayTM, PhonePe, Google Pay, Bank Transfer, or Credit/Debit Cards). AMHS does not store sensitive payment data such as card numbers or CVV.

Offline (in-clinic) sessions — Pay at Clinic:

  • AMHS offers a Pay at Clinic option for offline sessions booked at our physical location. No online payment is required to hold this type of slot.
  • Because Pay at Clinic slots are not secured by prepayment, they are subject to the additional confirmation, attendance, and no-show safeguards set out in Section 5 below and in the AMHS Policies page.

Fees are subject to revision based on annual inflation or specialised therapy requirements. Current charges are displayed at checkout or shared by the clinic team at the time of booking.

5. Offline / In-Clinic Sessions

The following apply specifically to sessions booked at the AMHS physical clinic:

  • Booking confirmation: A Pay-at-Clinic booking is treated as a confirmed appointment once you receive a booking confirmation (via SMS/WhatsApp/email), even though no payment has been collected at that stage.
  • Slot confirmation: For Pay-at-Clinic bookings, AMHS admin will contact you on your registered mobile/WhatsApp number to confirm that you will attend. If you do not confirm your attendance when asked, AMHS may release the slot and offer it to another client.
  • Payment timing: The session fee must be paid in full at the clinic reception before the session begins. AMHS reception/admin staff are entitled to hold the start of a session until payment is completed; this is managed by admin and is not the therapist's responsibility.
  • Arrival time: Clients are requested to arrive at least 10 minutes before their scheduled slot to complete check-in and payment, so the session can begin on time.
  • Identification: Clients (or the parent/guardian of a minor client) may be asked to present a valid ID at check-in for verification.
  • No-shows: A Pay-at-Clinic booking for which the client does not arrive, or arrives more than 15 minutes late without prior notice, is treated as a no-show. Repeated no-shows may result in AMHS requiring online prepayment for future bookings, or suspending the Pay-at-Clinic option for that client's account (see AMHS Policies — “Pay at Clinic Policy” for full details).
  • Waiting area conduct: Please maintain a quiet and respectful environment in the clinic waiting area, in consideration of other clients and staff.

6. Cancellations, Rescheduling & Refunds

  • ≥ 8 hours before the session: Full refund (online, prepaid sessions).
  • 4–8 hours before session: 50% refund.
  • < 4 hours before / no-show: No refund.
  • Therapist cancellations: Client may opt for a full refund or free reschedule.
  • Pay-at-Clinic bookings are not eligible for a “refund” as no advance payment is collected, but the no-show consequences in Section 5 apply.

Refunds (if applicable) will be processed to the original payment method within 3–5 business days, subject to bank/payment provider timelines.

Rescheduling window (platform feature)

  • A session may be rescheduled through the AMHS platform only if the request is submitted at least 2 hours before the scheduled session start time.
  • Once a session is within 2 hours of its start time, the reschedule option is automatically disabled on the platform, and the booking is treated under the cancellation/no-show terms above.
  • This 2-hour window applies equally to online and offline (Pay-at-Clinic) bookings.
  • If you are unable to reschedule through the platform within this window and have an exceptional circumstance, you may contact AMHS support directly; accommodation is at AMHS's discretion and is not guaranteed.

7. Professional Boundaries, Client Conduct & Platform Use

  • Maintain professional respect and boundaries. Therapists and clients must not engage in personal, business, or social relationships.
  • Abusive, threatening, or inappropriate conduct — online or at the clinic — may result in termination of services without refund.
  • Recording or sharing sessions without prior written consent is prohibited.
  • Gifts, bartering, and exchange of services are not permitted.
  • Therapists are not available for casual calls/texts outside scheduled sessions, except for scheduling matters.
  • Use the AMHS dashboard for everything. All scheduling, rescheduling, cancellations, payments, and session-related communication must go through the AMHS client dashboard and official AMHS channels, not a therapist's personal phone, email, or social media. This keeps your bookings, refunds, and session history accurate, and lets AMHS step in if something goes wrong. Full detail is in the AMHS Policies — For Clients page.
  • If you'd like to continue with a therapist who leaves AMHS, this must be arranged through AMHS admin rather than privately with the therapist; AMHS therapists are separately bound not to solicit or facilitate such arrangements.
  • Educational/awareness content on AMHS platforms does not constitute therapy or crisis support.

8. Limitation of Liability

AMHS and its therapists are not liable for indirect, incidental, or consequential damages arising from service use. Our total liability, if any, shall not exceed the amount paid by the client for the session in question.

9. Intellectual Property

All website content, therapeutic materials, and branding are the intellectual property of AMHS. Reproduction or distribution without prior written consent is prohibited.

10. Termination of Services

AMHS may suspend or terminate services for non-payment, misuse, repeated no-shows, or if client needs fall outside professional scope. Clients may discontinue therapy at any time, subject to the refund and cancellation policies.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of India, including the Mental Healthcare Act, 2017.

12. Amendments

AMHS may revise these Terms periodically. Updates will be posted with a revised “Last Updated” date. Continued use constitutes acceptance of the revised Terms.
